Summary

As Introduced. Driving while using handheld personal communications device; penalty.

Provides that a person who, as a result of driving while in violation of the prohibition on using handheld personal communications devices in certain vehicles, unintentionally causes the death of another person is guilty of involuntary manslaughter, or aggravated involuntary manslaughter if the defendant's conduct was so gross, wanton, and culpable as to show a reckless disregard for human life. The bill establishes the penalty for aggravated involuntary manslaughter as one to 20 years' imprisonment with a mandatory minimum term of incarceration of one year. The bill creates a Class 6 felony if the driving while in violation of the prohibition on using handheld personal communications devices is so gross, wanton, and culpable as to show a reckless disregard for human life and results in the unintentional serious bodily injury of another resulting in permanent and significant physical impairment.
