Summary

As Introduced. Standards for testimony of expert witnesses.

Adopts two additional standards for admission of expert testimony found in Rule 702 of the Federal Rules of Evidence by (i) requiring that the expert's testimony be the product of reliable principles and methods and (ii) requiring that the expert has reliably applied the principles and methods to the facts of the case. The bill also codifies the requirement that the expert's testimony be based on sufficient facts or data (as recognized in Forbes v. Rapp, 269 Va. 374, 611 S.E.2d 592 (2005)). The bill does not change the current requirement that the expert's scientific, technical, or other specialized knowledge will assist the trier of fact in understanding the evidence or determining a fact in issue.
