Summary

As Introduced. Police misconduct; civilian review panel; law-enforcement auditor.

Authorizes a locality to establish a law-enforcement civilian review panel that may (i) receive complaints from citizens of the locality regarding the conduct of the primary law-enforcement agency serving the locality and its officers and employees and (ii) review investigations conducted by the agency into such conduct. The bill also authorizes a locality to appoint a law-enforcement auditor who may review investigations conducted by the agency regarding the use of force by a law-enforcement officer that resulted in the death or serious bodily injury of another person. The bill provides that the panel or auditor may conduct hearings and request that the city or county attorney seek a subpoena for witnesses and evidence. The bill provides that the panel and auditor shall report annually on their activities. Finally, the bill provides that the findings and recommendations made by the panel or auditor are not binding on the agency and nothing in the bill either requires or precludes the agency from conducting its own investigation.
